The privacy policy applies to ATS Polen (KRS: 0001082796, NIP: 7622020163, REGON: 527503397), where the general director is responsible for the processing of personal data by the company.
ATS Polen is responsible for the atspolska.pl domain.
We highly value the privacy of our users. At the same time, we depend on personal data to provide our services. By using the atspolska.pl service, you consent to our processing of personal data in the manner described below.
Your consent, together with the terms of the agreement to use our website, constitutes the legal basis for our processing of your personal data. In some cases, the basis for processing may be what is necessary to comply with a legal obligation.

ATS Polen specializes in intermediating the sale of used equipment for the construction and transport industries. The registered office address is Prosta 8a/13, 07-200 Wyszków.
What is personal data?
Personal data is all information and assessments that can be associated with you as an individual. Typical personal information includes name, address, telephone number, email address and social security number. By law, some identification numbers are also personal information, examples are: IP address, customer number, cookie ID/Internet ID (anonymous). Information about your behavior (ways of use, actions) is also defined as personal data.
Why we collect personal data
The purpose of processing personal data registered about you is primarily to mediate the purchase and sale of used equipment for the construction and transport industries - via our website atspolska.pl.
Our service requires buyers and sellers to create their own user on the website along with the personal information associated with it (~ see what personal information is collected ) in order to purchase and/or list products for sale. In addition, registered information about you is used to ensure the processing of shipments, contracts, financing and settlements.
Your contact details registered for your user will be used to be able to send you an email notification if you have set up a predefined search and when there is equipment for sale matching that search. You can delete these searches at any time. You will also receive a notification to your registered email address when your ads are ready to run.
If you wish to reset your password, your registered email address will also be used to perform this task.
Your registered phone number is used when you log in for the first time with your password. In addition, it will be agreed that your telephone number can be used for the communication channel (SMS) in connection with the finalization of the sale (for the buyer and the seller).
We may use your data for profiling in connection with marketing activities. We may also obtain structured personal information from credit reporting companies.
What personal data do we collect?
In order to provide our intermediation service at atspolska.pl, we need the following personal data registered by the user:
- Name
- Phone number
- Address
- Bank account (seller)
If you provide us with additional information, e.g. when creating an ad yourself, this will also be stored by us. However, the solution allows for anonymization of information contained in the images, e.g. registration number, etc.
Our solutions enable you to submit your ads to Mascus. These transfers will mainly concern data related to the items for sale, however, images that you have shared/uploaded may contain personal data. (In addition, personal data referred to in the free text may be stored).
In addition, the website uses various technologies so that we can constantly improve it for the benefit of the user. These are technologies such as Google Analytics and Google Tag Manager that help us analyze traffic and use of the website.
Additionally, Eurobate serves as a provider for sending SMS messages to users, and SendGrid is similarly used as a platform for sending email correspondence. For verification when creating a user, the Signicat solution is used, which is provided by various authentication methods such as biometrics, etc.

The age limit for using atspolska.pl is 18 years and is functionally controlled by providing your date of birth during registration.
How do we store personal data?
Our auction solution is provided by our partner BDO AS. The stored information about you as a user is stored on the servers of BDO's subcontractor, DigitalOcean. These are servers physically located in the EU/EEA.
Your data is only retained for as long as required to provide our services or as required by law. As long as you have an existing user on atspolska.pl, your registered information will not be stored. Deleting a user deletes your personal data if ATS Polen has no legal obligation to store it (e.g. accounting and bookkeeping obligation).
Anonymized information (which cannot be linked to you as an individual and therefore no longer constitutes personal data) may be stored for statistical purposes.
Our partner BDO AS uses subcontractors for data storage and basic technical solutions for digital communication and user authentication. This is information that can be obtained by contacting the solutions manager at BDO AS, who can be reached at websupportdrammen@bdo.no.
BDO AS, in accordance with the contract concluded with us (~data entrustment agreement), will process your personal data in the manner specified by us. We will instruct the data processor to ensure appropriate information security, including that personal data may not be transferred to other persons.
Who has access to personal data?
Our employees at ATS Poland will have access to personal data registered in our solution, in addition to any personal data entered directly via other channels, such as e-mail and telephone. In addition, technical systems managers (BDO AS) and system managers of our CRM Pointer solution (We Made AS) have access to the solution and will have access to the personal data stored here.
We do not sell or rent the information you provide to third parties.

What are your rights?
As a website user, regardless of whether you are a registered user or not, you have the right to request access to your personal data that we process and the method of processing it. You can also request rectification, deletion and limitation of the processing of personal data in accordance with the Regulations of the Data Protection Regulation (GDPR).
If the processing of personal data is based on consent, you can withdraw your consent at any time.
If you believe that ATS Polen did not respect your rights in accordance with the Regulations of the Data Protection Regulation (GDPR), you have the right to lodge a complaint with the competent supervisory authority. Social media
If you decide to follow ATS Polen on social media, you must be aware that the personal data and other information you have provided to these media may be read, collected and used by other users of the social media website.
We have little or no control over and are not responsible for the use, misuse or misuse of personal data or other information that you share on any social media service by others. As the owner of the websites, we receive visit and usage statistics, but we do not store this information ourselves.
